Terms of use
This document defines the terms of use, which come into effect as soon as the User activates or installs the Service. When using the Service, the User undertakes to comply with these terms, and the application of the terms is extended to all use of the Service.
Definitions
- The service refers to the Maija.io website and all its features.
- User means a person or company who purchased the Service.
- Customer refers to a person, organization, company or entity that, among other things, browses the User's properties on the housing portals included in the Service or has placed a sales order for the User.
- Object refers to a property or apartment uploaded to the Service for sale, rent or purchase.
- MIS refers to the company Maija International Software Oy LTD. MIS produces and owns the Service.
Entry into force and scope of the terms of use
These terms of use apply immediately when the User downloads the Service or uses it in any way. Use of the service is interpreted as consent to comply with these terms of use.
These Terms of Use are binding on all Users using this Service in any geographic location or on any platform. The scope includes all versions and updates of the Service, including add-ons provided by third parties.
If the User sells or rents an object with the help of the Service, these terms of use do not apply between the User and the Customer, but the terms of the contract between the User and the Customer are determined in accordance with the terms they have separately agreed upon. The service is not responsible for any issues between the User and the Customer. Neither the Service nor MIS is responsible for the Users' possible distributions of commissions, their definition, the Users' mutual payments or any other similar agreements between the Users.
The user has a separate agreement that entitles him to use the Service for the marketing of objects and his own business activities. If there is a conflict between the separate agreement between the Service and the User and these terms of use, the terms of the separate agreement shall apply.
Intellectual property rights
MIS has full and exclusive intellectual property rights to the Service in question. This includes, but is not limited to, copyrights, patents, trademarks and other intellectual property rights related to the design, development and implementation of the Service. All rights not expressly transferred or otherwise granted are retained by MIS, and no one else may use, modify, copy or distribute the Service or any part thereof without the express written permission of MIS.
The service and all the material it contains are copyright protected content. The intellectual property rights related to the appearance, code and material of the Service belong to the Service Provider and its partners.
Documents and other material downloaded from the service
The user has the right to use the documents and other material downloaded from the Service for his own professional use, taking into account the restrictions below:
- The user may not modify, reproduce, publicly present or otherwise make public documents and other material or use them for commercial purposes.
- The user may not collect parts of the Service or form their own Service or material entity from them.
- The user must keep the copyright and other rights-related notices contained in all documents and materials downloaded from the Service.
- When the user stops using the Service, he must stop using the documents and other material available from the Service, unless the law requires their storage.
Use of own documents and other material
The user has the right to use his own documents and other material.
Registration
The use of the service requires the User to register. When registering, a Username and password will be created. The user is responsible for the security of their own username and password. The user may not share his credentials with a third party.
The right of use is personal or company specific. The User works in the Service under his own name (first and last name) and the User must upload his own photo and the company's company ID to the Service. The service provider has the right to decide, without giving reasons, whether it accepts the registration or not.
The right to use the Service is personal, and the User ID and password may not be given to a third party. The user is responsible for all actions taken with his credentials and undertakes to inform the Service Provider immediately if he suspects that his credentials have been revealed to third parties.
The User has the right to ask the Service Provider to change the Username and password. The service provider has the right to charge for this the amount according to the price list.
The service provider has the right to close the access right if it suspects that the access right is being misused.
The user agrees to receive notifications or communications from the Service, such as updates, newsletters or other announcements.
Personal and other information
The service uses cookies and other similar technologies. The service provider complies with valid personal data legislation. The customer can request the deletion or correction of personal data collected by the Service at any time. More information can be found in the Service's privacy statement.
The User must note that the Service or the information obtained through it may not be used in any way against the law or for a purpose that would endanger the privacy of the Customers.
After the end of the agreement, the information of the User and his Customers will be deleted from the Service. The user's items are removed from the Service after 6 months and the Customer's after 12 months. No other User of the Service is in contact with other Customers, unless it is a shared Customership. MIS is not responsible for any deleted information of the User.
MIS is entitled to collect statistical data on the use of the Service and to use it including, but not excluding, statistically, commercially and in the way it deems best for its development activities. Personal data cannot be disclosed, unless otherwise required by law.
Disclaimer
The service provider acts as a platform for real estate agents and construction companies. The service is intended for property marketing, sales and customer management. The Service Provider is not responsible for any agreements between the User and the Customer, targeted notifications, offers, etc. MIS is not responsible for the legality of the information provided in the Service.
The User acknowledges that the use of the Service is entirely at his own risk, and the User is solely responsible for all possible consequences resulting from the use of the Service. MIS shall not be liable for any direct or indirect loss or damage of any kind, including but not limited to indirect and consequential damages, such as loss of revenue, business interruption or loss of data, due to the use, content, interruption or coverage of the Service. MIS is not responsible for errors, interruptions or availability of information systems or damages caused by malware or viruses.
MIS does not give any direct or indirect guarantees about the functionality or suitability of the Service for its purpose of use. MIS is not responsible for changes in the Service's functionality or features that may result from updates to the Service. The User acknowledges that third-party services or components connected to the Service may be subject to their own terms and conditions, and MIS is not responsible for them.
Price of service
The price of the service is valid for the entire purchased contract period, unless otherwise agreed separately.
The service provider has the right to change the price of the service by announcing it in advance. Price changes can be related to, for example, improvements in service features or general cost changes. Potential price changes are notified to users in advance, usually during the period preceding the contract period. The user is considered to have received information about the price change within 7 days of sending the email or posting it on the Service's website.
After the price change, the user must pay the new changed price for the service. By continuing to use the service after the price change, the User is deemed to have accepted the new changed price.
Applicable legislation
This Service and related terms of use are governed by Finnish laws, regardless of where the User is located or where the Service is used. Possible legal actions and claims related to the use of the Service or these terms of use must be filed in accordance with Finnish laws.
MIS reserves the right to specify exceptions or additional conditions for certain territories or legal systems as necessary.
Rules of practice
The user undertakes to do his work carefully and to add the information and photos of the objects as well as possible, following the laws and other rules regarding the content. The user is responsible for the content he produces. The User is responsible for the fact that the User has the right to report the Object in the Service, meaning that a written agreement has been made with the Customer for each object in the Service, which is saved in the system.
You can list the same object in the service only once. Incomplete or missing customer property listing is the User's own responsibility, if another User refers to an incomplete or incorrect listing of a property. The User undertakes to cooperate with other Users of the Service and promotes cooperation with their own activities. If the Item is sold as a collaboration between two Users, the fee received from it will be divided in half, unless otherwise agreed in writing. If the User sends a customer as a tip to another User, the reward is divided 30% by the User who sent the customer and 70% by the other User, unless otherwise agreed in writing. The service is not responsible for the Users' mutual payment posts.
Violations of Terms of Use
If the Service is used in violation of the Terms of Use, authorities' instructions, other contractual terms, laws or good practice, the Service Provider has the right to prevent the use of the Service and the services paid for the price of the Service will not be returned.
It is also considered abuse if you do not agree to pay the price of the Service or the payment transaction does not go to MIS.
MIS is not responsible for any damages resulting from the suspension of the Service, violation of the User's terms of use or failure to pay.
Duration of the contract
The User enters into an agreement for the use of the Service when registering as a User of the Service. The service is paid in advance with an online payment, and the price consists of the number of properties to be listed, the months of use and the number of apartment portals used.
The service is temporary. You can stop using the service within the specified period, but the payments made will not be refunded.
If the User wants to extend the right to use the Service for a new limited period, the User must make a new payment before the end of the then-current right of use period, ensuring the preservation of the items left in the Service.
The user can stop using the service by stopping his payment or notifying the Service. The user can return to the Service as a user later by entering into a new contract in accordance with the then valid contract terms.
